 Here's the question: When it comes to the Elena Kagan nomination, will Senate Republicans roll over and play dead like obedient dogs... or will they grow spines and mount a FILIBUSTER? Yes, we know that sounds rough, but now is not the time to mince words because, only you have the power to make our elected leaders do the right thing and FILIBUSTER the Kagan confirmation. And the time to make it happen... the time to make your voice heard... is right now. It is already all too apparent to patriotic Americans... Democrats, Republicans and Independents alike... that Barack Obama's nomination of Elena Kagan to the High Court is nothing more than a clumsy attempt to place an extreme left-wing political activist (not a jurist) on the High Court... it's clearly nothing more than an attempt to radically alter the Supreme Court and transform it into a rubber stamp for Obama's frightening extreme left-wing agenda for generations to come. While Barack Obama and his allies in the left-wing media have made every attempt to paint Kagan as a "moderate," the truth of the matter is that Barack Obama nominated Kagan precisely because she has a life-long history of extreme and radical left-wing political activism and her personal history clearly indicates that she WILL legislate her far-left wing agenda from the bench. The Washington Times makes a sound case in favor of opposition to Kagan's confirmation: "Solicitor General Elena Kagan is too political, too leftist, too inexperienced and too disrespectful towards existing law to be confirmed for the U.S. Supreme Court. ...what we now know about her should disturb fair-minded Americans..." Yes, "fair-minded Americans" should be disturbed... and rational people should be very afraid because Elena Kagan is an extreme leftist... a political activist (not a jurist) and she has a radical agenda. As The Times states, Kagan is "disrespectful toward existing law" (and, by inference, the Constitution)... and clearly, she will have no problems forcing her warped worldview on the rest of us, through judicial fiat, from the bench. That makes Kagan a very dangerous person... and, for that reason alone, her confirmation must be stopped. People still email us ask if bombarding the fax machines and phone lines of our elected officials has any effect. The answer, particularly in this case, is YES. Several weeks ago, when we first sounded the alarm over the Kagan nomination, few were calling for a filibuster... as a matter of fact, the inside-the-beltway pundits, for the most part, actually scoffed at the idea of filibustering Kagan. By default, patriotic Americans like you were among the FIRST to spring into action... you were among the FIRST to speak out and DEMAND that our elected officials ACTUALLY FILIBUSTER the Kagan nomination. Of course, back then, Republican senators were clearly unwilling to even consider the possibility of filibustering Kagan. Their plan of action was to hold a dog-and-pony show and only offer token resistance to the Kagan confirmation. Senate Minority Leader Mitch McConnell even let the cat out of the bag and said that a filibuster of Kagan was "highly unlikely." But patriotic Americans like you refused to accept that spineless response... you tipped the balance... and AFTER you started bombarding Senators with your Blast Faxes and calls... others jumped on the bandwagon and started calling for a Kagan filibuster too... and now, even some of our elected officials are starting... just starting mind you... to see the light. In fact, McConnell is shifting his position and recently said that a filibuster of Kagan is "possible." Specifically, McConnell said: "We know that the president has filibustered Supreme Court nominees. We know the vice president has filibustered Supreme Court nominees. We know Senator Reid has and we know Judiciary Committee Chairman Leahy has.... I have never filibustered a Supreme Court nominee. But it is possible..." And on Sunday, the Ranking Member of the Senate Judiciary Committee, Jeff Sessions, told CBS News that a filibuster is "not off the table" and that it is "conceivable." Specifically, Session said: "Will she as a judge subordinate herself to the Constitution and keep her political views at bay? And then secondly, if things come out to indicate she's so far outside the mainstream, it's conceivable a filibuster might occur." Of course, patriotic Americans like have known for some time that Kagan is "far outside the mainstream" and, it should go without saying that our elected officials (even the extreme ideologues who have the audacity to support Kagan) already know it as well. But make no mistake... this sudden willingness on the part of some of our elected officials to change course did not happen spontaneously... YOU MADE IT HAPPEN... patriotic Americans, like you, TOOK THE LEAD... patriotic Americans like you BLAZED THE TRAIL. You deserve the credit... you deserve the praise. But our work is far from done because, presently, our elected officials are not where they need to be... they're simply sticking their fingers in the air to see which way the wind is blowing... they're asking... is this ground-swell for real... will the American people actually support us if we mount a filibuster? While the obvious answer is yes, the fact that our elected officials are behind the power curve is nothing new... but since they're checking the direction of the wind, it is pivotal that you give them a hurricane... in short, it is vital that they hear from you, right here and right now. And that means that if you've already sent Blast Faxes to our elected officials and demanded a Kagan filibuster, now is the time to do it again. That means that if you've never sent Blast Faxes to our elected officials, now is a good time to do it for the very first time. Radio talk-show host, Rush Limbaugh, said that Kagan exhibits a "hot and bothered passion" for Socialism and this passion is readily seen in Kagan's Princeton thesis. In her own words, she practically weeps over the demise of Socialism in the United States: "In our own times, a coherent socialist movement is nowhere to be found in the United States. Americans are more likely to speak of a golden past than of a golden future... of capitalism's glories than of socialism's greatness. ... Such a state of affairs cries out for explanation. Why, in a society by no means perfect, has a radical party never attained the status of a major political force? Why, in particular did the socialist movement never become an alternative to the nation's established parties?" This unbridled passion for Socialism is arguably enough to disqualify her from sitting on our nation's High Court, but it just scratches the surface when it comes to Barack Obama's mystery nominee. In fact, it is now coming to light that Kagan may also exhibit open hostility toward the First Amendment. According to The Washington Times: "We know she is willing to undercut First Amendment free speech for political purposes. Ms. Kagan argued before the Supreme Court that the law should be read to allow the government to prohibit the publication of political pamphlets. In a nation stirred to its own founding by political pamphlets such as 'Common Sense' and 'The Federalist Papers,' this is an extremely disturbing position. Ms. Kagan also has written of the benefits of 'redistribution of expression,' and has written that speech rights are to be 'dol[ed] out' as a 'favor' from government rather than being pre-existing rights that government cannot take away. She has argued that government would be justified in 'disfavoring [an] idea [to] 'unskew,' rather than skew, public discourse.'" If, by chance, you skimmed through the above quote, read it again... it's truly chilling. Does Kagan actually believe that our First Amendment rights come from the federal government... that they are not innate... that they are not God-given... that the government does us a "favor" when it allows us to speak out... and that the government has the right, verily, the duty, to suppress the publication of political pamphlets to "unskew" the public discourse at the discretion of those in power? By now, everyone knows that Kagan banned military recruiters while she was the Dean of the Harvard Law School and, in doing so, figuratively slapped our brave men and women in uniform in the face during a time of war because she objected to the military's "Don't Ask, Don't Tell" policy. What many DON'T know is that Kagan acted alone and that her actions were a direct and blatant VIOLATION of United States law. You read that right... a VIOLATION of United States law. The Washington Times again: "We know she deliberately ignored the law while at Harvard, and unfairly besmirched our military in time of war. The facts are simple. A law known as the Solomon Amendment made it illegal to keep military recruiters off of college campuses. ... Then-Dean Kagan barred the recruiters from campus anyway, thus flouting the law. ... Somebody who openly flouts the law should not be one of the law's ultimate arbiters." The Family Research Council echoes those sentiments: "[N]ot only was Elena Kagan key in kicking military recruiters off campus, directly violating U.S. law, she did so more or less independently - not even consulting the dean of Harvard University, Lawrence Summers. The law she violated was the Solomon amendment that insists that if your university accepts federal funds it should also accept military recruiters. She called the current policy of 'Don't Ask Don't Tell,' which was created by her future boss President Bill Clinton and supported by the Democratic Congress at the time, 'a moral injustice of the first order.' She was so outraged that she did not work with the Pentagon to find a solution, instead leaving that work to others, which was fine to Military leaders at the time who found her hostility to them prevalent. If Ms. Kagan has such disdain for passed legislation she disagrees with that she is willing to violate the law instead of seeking a solution, does she really have the temperament to have a permanent seat on the U.S. Supreme Court?" But here's a very interesting twist. According to Senator Sessions: "Ms. Kagan was perfectly willing to obstruct the U.S. military - which has liberated countless Muslims from the hate and tyranny of Saddam Hussein and the Taliban. But it seems she sat on the sidelines as Harvard created an Islamic Studies Center funded by - and dedicated to - foreign leaders presiding over a legal system that violates what would appear to be her position.... She fought the ability of our own soldiers to access campus resources, but not those who spread the oppressive tenets of Islamic Sharia law. Perhaps her response was guided by campus politics. But...much of her career has been spent actively engaged in liberal politics - not legal practice." Contradiction? ... Hypocrisy? ... Or, does her support for the Islamic Studies Center simply indicate that Kagan never encountered a liberal cause that she didn't like... that anything and everything anti-American suits her just fine? Does her seeming contradiction actually indicate, as Senator Sessions says, that she simply values " liberal politics - not legal practice." It is also becoming clear that Kagan believes that judges should legislate from the bench. The Washington Times again: "We know she believes judges should automatically favor certain classes of people and impose their own values to reach desired outcomes. In short, judges should be super-legislators. We know she believes this because she has written as much. She wrote in 1993 that it is a 'thing of glory' for the Supreme Court to see its primary mission as 'show[ing] a special solicitude for the despised and disadvantaged.'" The Times goes on to say: "She has acclaimed as her greatest 'judicial hero' the radical Israeli judge Aharon Barak, who openly bragged that his 'judicial philosophy is enshrined in the recognition that his role is to create rights.' Not enforce rights recognized by the people, but create those rights himself. That's dangerous, yet it echoes what Ms. Kagan herself wrote in her Oxford University thesis in 1983, namely that 'as participants in public life, judges will have opinions, prejudices, values. Perhaps most important, judges will have goals. ... And because this is so, judges will often try to mold and steer the law in order to promote certain ethical values and achieve certain social ends. Such activity is not necessarily wrong or invalid.'" The Times is not alone in making that accusation. According to LifeNews.com, Kagan's "writings dating back to her college days are filled with accolades for judges who took the law into their hands and twisted it for a desired outcome rather than relying on the people through their elected officials." And some of the writings of judge Aharon Barak, Kagan's "hero," are rather disturbing as well. According to Phillip L. Jauregui with the Judicial Action group, Barak also wrote that:
